A family residence permit in Turkey allows qualifying foreign spouses and children to reside with a sponsor covered by Article 34 of Law No. 6458. Eligibility depends on both the family relationship and the sponsor’s circumstances. The permit can be issued for up to three years at a time, but cannot outlast the sponsor’s residence permit. Marriage alone does not dispense with the income, accommodation, insurance and other applicable conditions.
This is a residence route. Turkish citizenship by marriage is a separate application with different conditions. Other residence categories are explained in the residence permit types guide.
1. Who Can Sponsor a Family Residence Permit?
Article 34 covers Turkish citizens, people within Article 28 of the Citizenship Law, foreigners holding a residence permit, refugees and subsidiary-protection beneficiaries. The qualifying relatives are the foreign spouse, the minor foreign child of the sponsor or spouse, and their dependent foreign child. The dependent-child category should not be reduced to a rule covering minors only.
“(1) Türk vatandaşlarının, 5901 sayılı Kanunun 28 inci maddesi kapsamında olanların veya ikamet izinlerinden birine sahip olan yabancılar ile mültecilerin ve ikincil koruma statüsü sahiplerinin; a) Yabancı eşine, b) Kendisinin veya eşinin ergin olmayan yabancı çocuğuna, c) Kendisinin veya eşinin bağımlı yabancı çocuğuna, her defasında üç yılı aşmayacak şekilde aile ikamet izni verilebilir. Ancak, aile ikamet izninin süresi hiçbir şekilde destekleyicinin ikamet izni süresini aşamaz.”

Unofficial translation: “(1) A family residence permit may be granted, for periods not exceeding three years each time, to the foreign spouse, the minor foreign child of the person or spouse, and the dependent foreign child of the person or spouse, of Turkish citizens, persons within Article 28 of Law No. 5901, foreigners holding one of the residence permits, refugees and holders of subsidiary protection status. However, the duration of a family residence permit may in no case exceed the sponsor’s residence permit duration.”
Where the sponsor has more than one spouse under the law of their nationality, only one spouse may receive a family permit, although children from the other spouses may also qualify. Article 34(2) addresses that situation expressly.
2. Sponsor Requirements: Income, Housing and Insurance
Article 35(1) requires two income conditions together: total monthly income at least equal to the minimum wage, and at least one third of the minimum wage per family member. Checking only the total can miss the per-person condition. The article uses the minimum wage as the reference; the actual amount must be assessed against the applicable wage rather than a fixed figure copied from an older guide.
“(1) Aile ikamet izni taleplerinde, destekleyicide aşağıdaki şartlar aranır: a) Toplam geliri asgari ücretten az olmamak üzere, ailedeki fert başına asgari ücretin üçte birinden az olmayan aylık geliri bulunmak b) Ailenin nüfusuna göre, genel sağlık ve güvenlik standartlarına uygun barınma şartlarına sahip olmak ve tüm aile fertlerini kapsayan sağlık sigortası yaptırmış olmak c) Başvuru tarihi itibarıyla, beş yıl içinde aile düzenine karşı suçlardan herhangi birinden hüküm giymemiş olduğunu adli sicil kaydıyla belgelemek ç) Türkiye’de en az bir yıldır ikamet izniyle kalıyor olmak d) Adres kayıt sisteminde kaydı bulunmak”

Unofficial translation: “(1) In applications for a family residence permit, the following conditions are required of the sponsor: a) to have a monthly income not less than one third of the minimum wage per person in the family, with the total income being not less than the minimum wage; b) to have accommodation conditions complying with general health and safety standards according to the size of the family, and to have taken out health insurance covering all family members; c) to document by criminal record that they have not been convicted of any of the offences against family order within five years as at the date of application; ç) to have been staying in Türkiye with a residence permit for at least one year; d) to be registered in the address registration system.”
The sponsor must also have suitable accommodation for the size of the family, health insurance covering the family members, the specified criminal-record evidence concerning offences against family order in the preceding five years, and address registration. The ordinary one-year residence-permit condition has express exceptions; it is not a universal waiting period for every family.
2.1. Who Is Exempt from the One-Year Residence Condition?
Article 35(2) exempts holders of scientific-research residence permits or work permits, people within Article 28 of the Citizenship Law, and foreigners married to Turkish citizens from paragraph (1)(ç). That exemption concerns the residence period; it does not itself waive all the other conditions.
“(2) Bilimsel araştırma amaçlı ikamet izni ya da çalışma izni bulunanlar, 5901 sayılı Kanunun 28 inci maddesi kapsamında olanlar veya Türk vatandaşlarıyla evli olan yabancılar hakkında, birinci fıkranın (ç) bendi uygulanmaz.”

Unofficial translation: “(2) The sub-paragraph (ç) of the first paragraph is not applied in respect of those holding a residence permit for the purpose of scientific research or a work permit, those within the scope of Article 28 of Law No. 5901, or foreigners married to Turkish citizens.”
Article 35(4) separately permits the paragraph (1) conditions to be waived for refugees and subsidiary-protection beneficiaries in Turkey. The provision is discretionary and should not be treated as a waiver applicable to every foreign sponsor.
3. What Must the Applicant Prove?
The applicant must document the qualifying relationship, show that they live or intend to live with the sponsor, and satisfy the other applicant conditions. Both spouses must have reached eighteen. A marriage made solely to obtain the family permit does not satisfy the provision.

The family records should explain the relationship relied on: marriage for a spouse application, parentage and age for a minor child, or dependency where that is the basis. Sponsor evidence addresses a different part of the application, including income, insurance, housing and address. The official document list for the selected application should be checked alongside these statutory conditions.
4. How Do You Apply and Renew the Permit?
The Presidency of Migration Management’s General Information page directs first, extension and transfer applications to the official e-Residence system. For first and transfer applications, it also directs applicants to attend the provincial migration directorate with the required documents on the appointment date. The page does not show a publication date; these operational instructions were checked on 19 September 2026.
For renewal, Article 24 requires an application within the period beginning sixty days before expiry and, in every case, before the existing permit expires. It provides for a fee-free document allowing residence until the extension decision. This protection while awaiting the renewal decision is different from the position after a refusal.
“(2) Uzatma başvuruları, ikamet izni süresinin dolmasına altmış gün kalmasından itibaren ve her koşulda ikamet izni süresi dolmadan önce valiliklere yapılır. İkamet iznini uzatma başvurusunda bulunanlara, harca tabi olmayan bir belge verilir. Bu yabancılar, ikamet izni süreleri sona ermiş olsa dahi haklarında karar verilinceye kadar bu belgeyle Türkiye’de ikamet edebilir.”

5. What Are the Rules for Children?
Where a parent abroad shares custody, Article 34(3) requires that parent’s consent for the child’s family residence permit. Article 34(4) allows primary and secondary education until eighteen without a separate student residence permit. After at least three years on a family permit, a person who reaches eighteen may request conversion to a short-term permit under paragraph (5).
“(3) Çocukların aile ikamet izninde, Türkiye dışında varsa ortak velayeti bulunan anne veya babanın muvafakati aranır. (4) Aile ikamet izinleri, on sekiz yaşına kadar, öğrenci ikamet izni almadan ilk ve ortaöğretim kurumlarında eğitim hakkı sağlar. (5) En az üç yıl aile ikamet izniyle Türkiye’de kalmış olanlardan on sekiz yaşını tamamlayanlar, talep etmeleri hâlinde bu izinlerini kısa dönem ikamet iznine dönüştürebilir.”

These provisions answer different questions: consent concerns the application, the education rule concerns schooling while holding the family permit, and conversion concerns the change of residence basis on reaching adulthood. A parent’s application should not assume that the child’s status changes automatically without a request.
6. Divorce, Domestic Violence and the Sponsor’s Death
Divorce does not create an unconditional right to keep the same family permit. Article 34(6) permits a short-term residence permit for a foreigner who was married to a Turkish citizen and spent at least three years on a family permit. Where a court establishes that the foreign spouse was a victim of domestic violence, the three-year condition is not required. The court finding and the alternative permit application are distinct issues.
Where the sponsor dies, paragraph (7) permits a short-term permit for those residing on a family permit linked to that sponsor without a duration condition.
“(6) Boşanma hâlinde, Türk vatandaşıyla evli yabancıya, en az üç yıl aile ikamet izniyle kalmış olmak kaydıyla kısa dönem ikamet izni verilebilir. Ancak yabancı eşin, aile içi şiddet gerekçesiyle mağdur olduğu ilgili mahkeme kararıyla sabit ise, üç yıllık süre şartı aranmaz. 7. How Is a Suspected Marriage of Convenience Examined?
Reasonable suspicion allows the governorship to investigate whether the marriage was entered into solely to obtain residence. Article 37 permits checks before issue or renewal and after a permit has been issued. If that purpose is established, the permit is refused or cancelled. Periods under a permit later cancelled on that basis are not counted towards the statutory residence totals.
“(1) Aile ikamet izni verilmeden veya uzatılmadan önce makul şüphe varsa, evliliğin sırf ikamet izni alabilme amacıyla yapılıp yapılmadığı valiliklerce araştırılır. Araştırma sonucunda, evliliğin bu amaçla yapıldığı tespit edilirse aile ikamet izni verilmez, verilmişse iptal edilir. (2) Aile ikamet izni verildikten sonra da evliliğin anlaşmalı olup olmadığı konusunda valiliklerce denetim yapılabilir. (3) Anlaşmalı evlilik yoluyla alınan ve sonradan iptal edilen ikamet izinleri, bu Kanunda öngörülen ikamet izin sürelerinin toplanmasında hesaba katılmaz.”

The evidence matters. In a case concerning a visit to the declared address during the summer, the applicant explained that the couple spent those months in the spouse’s home province. The Council of State found the investigation insufficient and upheld annulment of the refusal. Its reasoning required concrete information and documents, rather than an unsupported conclusion about the marriage:
“6458 sayılı Kanun’un 35., 36. ve 37. maddelerinin yukarıda yer verilen hükümleri birlikte değerlendiriliğinde; yabancıların sırf aile ikamet izni almak amacıyla anlaşmalı evlilik yapıp yapmadığı hususunun valiliklerce araştırılacağı, bu araştırma sonucunda anlaşmalı evlilik yaptığı tespit edilen yabancılara aile ikamet izni verilmeyeceği ve verilmişse de iptal edileceği düzenlemelerine yer verildiği görüldüğünden, idarece evliliğin anlaşmalı bir evlilik olduğu hususunun tespit edilmesi üzerine bu sebeple işlem tesis edilmesinde hukuki bir engel bulunmadığı anlaşılmakla birlikte, evliliğin anlaşmalı bir evlilik olduğu hususundaki tespitin somut bilgi ve belgelere dayalı olması gerektiği de açıktır.”

This decision does not make every marriage sufficient or every address check invalid. It examines whether the conclusion was supported by the investigation in that file. How much income is required?

Must a work permit holder wait one year to sponsor family?
