Residence Permit Rejection in Turkey: Appeal and Deadlines

A residence permit rejection in Turkey should be assessed from the notified decision, the permit category and the reasons given. Refusal of a first application, refusal to extend and cancellation of an existing permit are different acts. For applications made inside Turkey, Article 25 of Law No. 6458 requires notification explaining the available remedies and other rights and obligations. An administrative-court action is generally subject to the sixty-day period in Article 7 of Law No. 2577, unless a special period applies.

The time available to challenge a decision is not itself permission to remain in Turkey. Filing a case also does not automatically suspend the decision. The refusal, current residence basis and any separate removal or entry-ban decision must be examined together.

1. Read the Refusal and Notification First

Article 25 identifies the governorship as the authority responsible for in-country refusal, non-extension and cancellation, and their notification. The notice must explain how the person can exercise appeal rights and the other rights and obligations during the process.

“(2) İkamet izni talebinin reddi, iznin uzatılmaması veya iptali, yabancıya ya da yasal temsilcisine veya avukatına tebliğ edilir. Tebligatta, yabancının karara karşı itiraz haklarını etkin şekilde nasıl kullanabileceği ve bu süreçteki diğer yasal hak ve yükümlülükleri de yer alır.”

Unofficial translation: “The refusal of a residence permit request, the non-extension or the cancellation of the permit is notified to the foreigner or to their legal representative or lawyer. The notification also sets out how the foreigner may effectively exercise their rights of appeal against the decision, and their other legal rights and obligations in this process.”

Keep the decision and the proof of notification together. Identify which application was refused, the statutory provision relied on, the authority making the act and any separate decision served with it. An application-status message should not be used as a substitute for examining the actual decision and service record.

2. Why Can a Short-Term Residence Permit Be Rejected?

Article 33 links short-term refusals to failure or loss of the Article 32 conditions, misuse of the permit’s purpose, and a valid removal or entry-ban decision. The relevant explanation depends on the ground actually used. A document showing an address, for example, does not by itself establish that the claimed purpose of residence was accepted.

“(1) Aşağıdaki hâllerde kısa dönem ikamet izni verilmez, verilmişse iptal edilir, süresi bitenler uzatılmaz: a) 32 nci maddede aranan şartlardan birinin veya birkaçının yerine getirilmemesi veya ortadan kalkması b) İkamet izninin, veriliş amacı dışında kullanıldığının belirlenmesi c) (Mülga: 28/7/2016-6735/27 md.) ç) Hakkında geçerli sınır dışı etme veya Türkiye’ye giriş yasağı kararı bulunması”

The text marks paragraph (1)(c) as repealed. Paragraph (2) leaves the rules on cancellation because of time abroad to the implementing regulation. An old fixed absence threshold should therefore not be presented as the current wording of Article 33.

For the underlying application conditions and alternative categories, see residence permit types in Turkey. A fresh application on a different basis and a challenge to the existing refusal are different matters; one should not be assumed to preserve the deadline for the other.

3. Family Permit Refusal and the Best Interests of the Child

Article 36 addresses family permits separately. It includes failure or loss of sponsor or applicant conditions, failure to obtain short-term residence after the family conditions cease, a valid removal or entry-ban decision, and misuse of the family permit. Its former paragraph (1)(d) is repealed. Marriage-of-convenience investigations have their own rule in Article 37.

“(1) Aşağıdaki hâllerde aile ikamet izni verilmez, verilmişse iptal edilir, süresi bitenler uzatılmaz: a) 35 inci maddenin birinci ve üçüncü fıkralarında aranan şartların karşılanmaması veya ortadan kalkması b) Aile ikamet izni alma şartları ortadan kalktıktan sonra kısa dönem ikamet izni verilmemesi c) Hakkında geçerli sınır dışı etme veya Türkiye’ye giriş yasağı kararı bulunması ç) Aile ikamet izninin, veriliş amacı dışında kullanıldığının belirlenmesi d) (Mülga: 28/7/2016-6735/27 md.)”

Article 25 requires the authority to consider family ties in Turkey, length of residence, conditions in the country of origin and the child’s best interests. It permits postponement of the residence decision. These factors do not make approval automatic, but they cannot be replaced by a general statement that every refusal has the same consequences.

“(1) Türkiye içinden yapılan ikamet izni talebinin reddi, ikamet izninin uzatılmaması veya iptali ile bu işlemlerin tebliği valiliklerce yapılır. Bu işlemler sırasında, yabancının Türkiye’deki aile bağları, ikamet süresi, menşe ülkedeki durumu ve çocuğun yüksek yararı gibi hususlar göz önünde bulundurulur ve ikamet iznine ilişkin karar ertelenebilir.”

Unofficial translation: “The refusal of a residence permit request made from within Türkiye, the non-extension or cancellation of a residence permit, and the notification of these acts, are carried out by the governorships. In the course of these acts, matters such as the foreigner’s family ties in Türkiye, duration of residence, situation in the country of origin and the best interests of the child are taken into consideration, and the decision on the residence permit may be postponed.”

Supporting material should explain the actual family circumstances and the effect of the decision on the child. The conditions for the underlying permit are explained in the family residence permit guide.

3.1. What Does the Court Examine in a Marriage Investigation?

The Council of State upheld a cancellation where the investigation recorded repeated unsuccessful address visits, neighbours’ accounts and inconsistent interview answers, and the file did not show family unity. The court quashed the first-instance judgment that had annulled the cancellation:

“Bu haliyle, yukarıda yer verilen tespitler uyarınca Türk vatandaşı eşi ile evlilik birlikteliği içinde yaşamadığı anlaşılan davacının aile ikamet izni almak amacıyla anlaşmalı evlilik yaptığı sonucuna varıldığından, 6458 sayılı Kanun’un yukarıda yer verilen 37. maddesi hükmüne uygun olarak tesis edilen dava konusu işlemde hukuka aykırılık bulunmadığından dava konusu işlemin iptali yolundaki İdare Mahkemesi kararında hukuka uygunluk bulunmamıştır.”

The finding concerns the evidence in that case. It does not establish that an absent spouse on one visit proves a marriage of convenience. The family-permit guide discusses a different decision where the investigation was insufficient. The practical question is what the record proves about the particular marriage.

4. What Is the Deadline for an Administrative-Court Action?

Article 7 sets the ordinary period at sixty days for administrative courts where no special period is prescribed. Under paragraph (2)(a), it begins on the day following written notification. Calculate the period from the relevant service record, not simply from the date printed on the refusal.

“1. Dava açma süresi, özel kanunlarında ayrı süre gösterilmeyen hallerde Danıştayda ve idare mahkemelerinde altmış ve vergi mahkemelerinde otuz gündür.”

The ordinary rule should not be transferred to a separate removal decision, which has its own procedure. If multiple decisions were served, identify each act and its applicable remedy before calculating time. Missing the distinction between the residence decision and a removal decision can lead to using the wrong period.

5. Does an Administrative Request Stop the Court Deadline?

Article 11 permits a request to the superior authority or, if there is none, to the authority making the act, within the judicial filing period. The request can seek removal, withdrawal or alteration of the decision or a new act. A request within this provision suspends the running period; it does not erase time already used.

“1. İlgililer tarafından idari dava açılmadan önce, idari işlemin kaldırılması, geri alınması, değiştirilmesi veya yeni bir işlem yapılması üst makamdan, üst makam yoksa işlemi yapmış olan makamdan, idari dava açma süresi içinde istenebilir. Bu başvurma, işlemeye başlamış olan idari dava açma süresini durdurur. 2. Otuz gün içinde bir cevap verilmezse istek reddedilmiş sayılır. [8] 3. İsteğin reddedilmesi veya reddedilmiş sayılması halinde dava açma süresi yeniden işlemeye başlar ve başvurma tarihine kadar geçmiş süre de hesaba katılır.”

If no response is given within thirty days, the request is deemed refused. After express or deemed refusal, the remaining judicial period resumes. Keep the date of the request and its receipt, together with any answer. Repeated correspondence should not be assumed to create new filing periods.

6. Which Court Is Competent?

Under Article 32, unless another rule specifies the competent court, the administrative court where the authority making the challenged act is located has territorial jurisdiction. For an in-country residence decision, identify the governorship from the decision itself. A move to another address does not by itself determine the court for an earlier act.

“1. Göreve ilişkin hükümler saklı kalmak şartıyla bu Kanunda veya özel kanunlarda yetkili idare mahkemesinin gösterilmemiş olması halinde, yetkili idare mahkemesi, dava konusu olan idari işlemi veya idari sözleşmeyi yapan idari merciin bulunduğu yerdeki idare mahkemesidir.”

7. Can You Remain in Turkey While the Case Is Pending?

Filing an administrative action does not automatically suspend the refusal or cancellation. A request for a stay of execution must address both manifest unlawfulness and harm that would be difficult or impossible to remedy under Article 27(2).

The temporary document issued for a pending extension application under Article 24 concerns the period until the extension decision. It should not be treated as an indefinite permission after refusal merely because a court case was filed. The notified obligations, any separate immigration decision and any interim court order require individual assessment.

8. What Should the Challenge Address?

A useful file connects each disputed finding to evidence. It contains the application and attachments, additional-document requests and responses, the notified decision, service records and the material relevant to the stated refusal ground. For a family decision, include evidence explaining the family situation and any issue concerning a child. For a cancellation, distinguish the conditions at the time of issue from the later event alleged to justify cancellation.

The request for interim protection should explain the particular harm from implementation and why the act is manifestly unlawful. Neither the filing of the action nor the fact that the applicant previously held a permit establishes those conditions on its own.

Frequently Asked Questions

How long do I have to challenge an ikamet rejection?

Article 7 of Law No. 2577 ordinarily gives sixty days for an administrative-court action unless a special period applies, beginning on the day after written notification. A separate removal decision must be assessed under its own procedure.

Does filing a case allow me to stay automatically?

No. Article 27 says filing an administrative action does not automatically suspend the challenged act. Current residence status, the notified obligations and any interim court order must be assessed separately.

Does an administrative objection give me a new sixty days?

Under Article 11, a qualifying request suspends the period already running. After express refusal or deemed refusal following thirty days without an answer, the remaining period resumes; time used before the request is counted.

Must family ties be considered before refusal?

Which court hears the challenge?

Article 24 concerns lawful residence until the extension decision. It should not be treated as indefinite residence after a refusal merely because litigation has begun.
